Dialogue Roundtable

The Iraqi Parliament Monitor discusses, in a dialogue roundtable, the constitutional repercussions of the arrest of a number of Council of Representatives members and its impact on quorum and balances.

The Iraqi Parliament Monitor at the Madarik Foundation hosted Judge Salem Rawdan and Mr. Haidar Muthanna, Director General of the Parliamentary Department, with the attendance of former MPs Dr. Mohammed Anouz and Dr. Raed Al-Maliki, in addition to a select group of legal specialists, advisors, media professionals and observers of the Council's performance, to discuss the legal and constitutional effects of the arrests that affected a number of Council members.
The dialogue addressed the legal status of the arrested MPs' absence from Council sessions and the extent to which this absence is consistent with the provisions of the Constitution and the Council's bylaws, particularly regarding the counting of forced absence resulting from arrest, and whether it is treated as voluntary absence entailing accountability procedures or loss of membership.
The session also discussed the impact of the detainees' absence on the quorum of sessions and the validity of voting on laws and resolutions, in addition to the problem of the fate of the electoral votes granted by voters to the arrested MPs, and the harm their possible cancellation would cause to the popular will and the principle of parliamentary representation.
The participants also paused at another equally serious dimension: the possibility of disturbing the existing weights and balances among the political blocs within the Council should the votes be cancelled, and the resulting change in the balances of voting and decision-making in a manner that does not reflect the election results that produced the Council's current composition.
The session concluded with a set of recommendations addressing the legal and constitutional issues raised, to be submitted to the Council's Presidency to take the necessary action, in a manner that preserves the integrity of the legislative process and protects voters' rights and the principle of parliamentary representation.
